1. Acceptance of Terms
By creating an account or using any part of the Platform, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and accept these Terms in full. If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Account Registration
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorised access. We reserve the right to suspend or terminate accounts that violate these Terms.
3. KYC and Identity Verification
To use financial features of the Platform (deposits, withdrawals, NFT purchases, and sales), you must complete Know Your Customer (KYC) verification. You agree to submit truthful and accurate identity documents. Providing false documentation is a violation of these Terms and may result in permanent account termination and referral to relevant authorities.
4. NFT Creation and Listing
When you create and submit an NFT on the Platform, you represent and warrant that:
- You are the original creator of the digital artwork or hold all necessary rights to mint and sell it.
- The content does not infringe any third-party intellectual property rights, privacy rights, or applicable law.
- The content does not contain illegal, harmful, defamatory, or obscene material.
All submissions are reviewed by our team. We reserve the right to reject any NFT that does not meet our standards without providing a reason.
5. Purchases and Transactions
All purchases made on the Platform are final unless otherwise stated. When you purchase an NFT, ownership of the digital asset is transferred to your account. Promintart is not responsible for fluctuations in the value of digital assets. Transaction fees are non-refundable. Any disputes regarding transactions must be raised within 7 days of the transaction date.
6. Deposits and Withdrawals
Deposits are subject to manual verification and minimum deposit limits. You must upload valid proof of payment; false or manipulated proofs will result in account termination. Withdrawals are subject to minimum and maximum limits, processing fees, and manual review. Promintart reserves the right to delay or deny withdrawals where suspicious activity is detected.
7. Prohibited Activities
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable law
- Upload content that infringes intellectual property rights
- Submit fraudulent transactions, false payment proofs, or manipulated documents
- Attempt to hack, disrupt, or interfere with the Platform's infrastructure
- Create multiple accounts for the purpose of abusing referral or bonus programs
- Engage in market manipulation, wash trading, or price fixing
- Harass, abuse, or harm other users of the Platform
8. Intellectual Property
The Platform, including its design, code, branding, and content produced by Promintart, is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent. You retain ownership of the original content you upload, but grant Promintart a non-exclusive, royalty-free licence to display and distribute your content as necessary to operate the Platform.
9. Disclaimer of Warranties
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Promintart does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or harmful components. Your use of the Platform is at your sole risk.
10. Limitation of Liability
To the fullest extent permitted by law, Promintart and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability to you for any claim shall not exceed the amount you paid to Promintart in the 12 months preceding the claim.
11. Termination
We may suspend or terminate your account at any time, with or without notice, for any violation of these Terms. Upon termination, your right to access the Platform ceases immediately. Provisions that by their nature should survive termination shall do so, including Sections 8, 9, 10, and 12.
12. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction, as determined by Promintart.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the new Terms.
